Welcome to The Ai Work Flo! These Terms and Conditions govern your purchase and subscription of our AI Agent services. By purchasing or subscribing, you confirm that you are authorized to act on behalf of your business and agree to these terms.


Acknowledgment and Agreement

By purchasing or subscribing, you confirm that you:

  • Are a business or authorized business representative.

  • Have read and understood these Terms and Conditions.

  • Agree to be bound by them on behalf of your business.


Scope of Services

The Ai Work Flo provides AI-powered customer engagement agents built to suit your business. You may choose from three live tiers (Bronze, Silver, Gold) with setup and monthly pricing.

  • Add-on modules are optional paid upgrades (subscription-only).

  • Custom AI agents are available upon request via a custom quote.


Delivery Timeline

  • Delivery is typically within 7 business days of payment and completed onboarding survey.

  • Delays due to complexity or incomplete input will be communicated promptly.

  • All prices are in USD. GST is applied to Australian customers.

  • You may choose to deploy your AI Agent across multiple platforms depending on tier (3–5).


Payment Terms

  • 100% upfront payment required for setup before work begins.

  • Monthly subscription charges begin after delivery and onboarding are complete.

  • Failure to pay monthly fees or token overages may result in deactivation.


Edits and Modifications

Included edits per plan (within 60 days of delivery):

  • Bronze – 1 wording change, 1 question add/remove

  • Silver – 2 wording changes, 2 question edits, 2 general edits

  • Gold – 3 wording changes, 3 question edits, 4 general edits

Additional edits are charged at $110 USD/hour (plus GST).


Token Usage Responsibility

Your plan includes a monthly token allowance:

  • Bronze: 2,500 tokens

  • Silver: 3,500 tokens

  • Gold: 4,500 tokens

If exceeded:

  • $20 USD + GST per 1,000 additional tokens

  • Invoiced monthly or automatically billed


Add-On Modules

Add-on modules (e.g., appointment setting, lead gen, escalation to human) can be added at any time.

  • Charged as a monthly add-on (no additional setup cost)

  • Billed along with your base subscription


Custom AI Agents

We offer custom AI agent builds for internal workflows, quoting tools, loyalty bots, etc.

  • Pricing varies based on scope

  • Please contact us for a tailored quote

  • Billed separately from tiered AI Work Flo plans


Subscription Details

  • Includes support, updates, and usage reports

  • AI Agent is disabled if payment lapses

  • You may cancel anytime with 14 days’ notice before the next billing cycle


Refund Policy

Full Refund Exception:

  • Cancel within 2 hours of payment, and no build work has started → eligible for full refund (subject to review).

Subscription Refunds:

  • 60-day satisfaction guarantee

  • Refund for unused days only within 60 days

  • No refunds after 60 days


Ownership & Use

  • All custom workflows and AI setups remain the intellectual property of The Ai Work Flo

  • Reuse or resale is prohibited unless approved in writing

  • Upon cancellation, AI Agents are decommissioned


Confidentiality & Data Privacy

  • All submitted business data is treated as confidential

  • Stored securely (e.g., encrypted Google Forms)

  • Deleted upon request

We do not sell, share, or transfer your information to third parties unless required by law.


Limitation of Liability

  • The Ai Work Flo is not liable for any indirect, incidental, or consequential damages

  • Liability is limited to the amount paid in the 12 months before the claim


Disclaimer of Warranties

  • Services provided “as-is”

  • No guarantee of uninterrupted performance

  • Suitability depends on the user’s business, implementation, and inputs


Indemnity

You agree to indemnify and hold harmless The Ai Work Flo, its owners, and staff against any loss arising from:

  • Misuse of services

  • Breach of these terms

  • Content or data submitted


Force Majeure

We are not liable for failure to deliver services due to events beyond our control, including but not limited to natural disasters, internet outages, or regulatory changes.


Governing Law & Dispute Resolution

These terms are governed by Australian law. Disputes are to be resolved through good faith negotiation, and if needed, binding arbitration or mediation within Australia.

International clients remain subject to these terms under Australian jurisdiction.


Entire Agreement

These Terms and our Privacy Policy constitute the full agreement. If any provision is held invalid, the remainder remains in effect.


Changes to Terms

Terms may be updated from time to time. We will notify users via email or through our website when major changes occur.

  • Usage Data: Token usage and interactions with your AI Agent, such as message logs (accessed only for billing or support purposes).

  • Third-Party Access Data: Permissions and access to your social media, websites, or other platforms as authorized by you to enable AI Agent integration.

  • Form Responses: Onboarding and feedback data collected via secure services like Google Forms.


2. Purpose of Data Processing

We process your data to:

  • Build, configure, and deliver your custom AI Agent.

  • Manage your subscription, billing, and token usage.

  • Provide ongoing support, updates, and maintenance.

  • Improve and develop our AI Agent services.

  • Comply with legal and regulatory requirements.

We do not use token message logs for analytics, profiling, or training. These logs are only reviewed when support or billing issues arise.


3. Legal Basis for Processing

Where applicable, we process your data based on one or more of the following:

  • Performance of a contract (e.g. AI Agent delivery).

  • Your consent (e.g. onboarding data).

  • Legitimate interests (e.g. fraud prevention, product improvement).


4. Data Sharing and Disclosure

We do not sell or rent your business data. We may share information with:

  • Service Providers: Such as Stripe (payment), Google (forms/data), or hosting providers. All partners operate under strict confidentiality and data protection terms.

  • Legal Authorities: When required by law or to protect rights and safety.


5. Data Security

We implement administrative, technical, and physical safeguards to protect your data:

  • Encrypted storage (where applicable).

  • Access controls for authorized personnel only.

  • Security assessments and privacy-aware workflows.


6. Data Retention

We retain your data only as long as needed to deliver our services and comply with legal or accounting obligations. You may request deletion of your business and usage data at any time.

As a business or authorized representative, you may:

  • Request a copy of your data.

  • Correct inaccuracies.

  • Request deletion or limitation of processing.

12. Governing Law & Dispute Resolution

This Privacy Policy is governed by the laws of the Commonwealth of Australia. Any disputes will first be handled via good faith negotiation. If unresolved, they may proceed to arbitration or mediation in Australia.

For international clients, this does not prevent seeking remedies in their local jurisdiction, but Australian law governs the service terms.
