Ai Agent Terms and Conditions, Privacy Policy, and Refund Policy

The Ai Work Flo – Terms & Conditions

Welcome to The Ai Work Flo! These Terms and Conditions govern your purchase, use, and subscription of our Ai agent services.

By purchasing or subscribing to our Ai agent solutions, you agree to these terms. Please read them carefully.

Scope of Services
Upon purchase, The Ai Work Flo will provide you with an Ai agent tailored to your business’s needs based on the information you provide during setup.

Your Ai agent will include features and capabilities according to the tier package you select (Bronze, Silver, or Gold).

Additional modules can be purchased separately to extend the functionality of your Ai agent.

Edits and Modifications
After purchase, you are entitled to 1 free inclusive edit to refine the configuration of your Ai agent. Edits include adjustments to tone, features, or behavior.

Additional edits beyond the included limit will incur a fee of $110 USD per hour per modification.
Edits must be requested within 60 days of purchase. After this period, further changes may not be covered under your original purchase agreement.

Self-managed Ai Account
Business owners need to sign up for their own OpenAi account and provide the API keys. They will be responsible for managing their own tokens and usage. Pricing for tokens can vary based on the model and usage.

Managed Ai Account
We can set up the OpenAi account on your behalf for a fee of $110/hr. You’ll still be responsible for managing it, including purchasing tokens for the Ai to run. Alternatively, we can handle the entire process for you for the same fee.

Training
We offer training for an additional fee of $110 per hour.

What Are API and Tokens?
API (Application Programming Interface): Allows the Ai agent to communicate with the system and retrieve or send data in response to customer interactions.

The API essentially powers the Ai agent.

Tokens: Tokens are the unit of measurement for usage in the API. Every time the Ai interacts or processes a piece of data (e.g., answering a question, understanding a message, etc.), it consumes tokens. Tokens are like credits used to “pay” for the Ai to perform tasks. More tokens allow more complex or frequent interactions.

To run an Ai Agent, it uses a program called ‘OpenAi’ using API keys. To run the API in a deployed state (i.e., on a website), it uses tokens. Tokens allow the Ai agent to communicate with the API system to retrieve or send data in response to all customer interactions on your live ‘Core’ Ai Agent.

Edits Allowed Per ‘Core’ Ai Agent
Bronze Core: Small wording adjustments to questions or answers, add or remove one question for customization.

Silver Core: Small wording adjustments to questions or answers, add or remove two questions for customization, choose 2 other additional edits (choose an extra thing to modify—can be a question or answer but cannot be additional from what is already in base questions).

Gold Core: Small wording adjustments to questions or answers, add or remove three questions for customization, choose 4 other additional edits (choose an extra thing to modify—can be a question or answer but cannot be additional from what is already in base questions).

Once payment is made, you will fill out a 10-question survey to proceed with building your Ai agent. We will deliver your Ai agent within one week on your selected deployment platform, complete with usage instructions and a video tutorial.

Subscription will start after delivery.

Once payment is made, you will fill out a 20-question survey to proceed with building your Ai agent.

Delivery of your Ai agent may take a little longer than one week. However, we will keep you notified if the timeline extends beyond this, and it will be deployed on your selected platform, complete with usage instructions and a video tutorial.

Subscription will start after delivery.

Refund Policy
We offer a 60-day satisfaction guarantee on all Ai agent subscriptions. If you cancel within 60 days of purchase, you are eligible for a refund. Refunds are issued on a prorated basis, meaning:
If you have a monthly subscription, you will be refunded for the remaining unused days in your current billing cycle.

Refunds will be processed back to your original payment method within 5-10 business days.

If you have any questions or need assistance with your refund, please contact our support team. After the 60-day period, refunds will not be issued.

Ownership and Use
The intellectual property rights for the Ai solutions used by The Ai Work Flo remain with their respective providers. The customization, configuration, and implementation we provide are proprietary to our services.

Upon termination of your subscription, access to your Ai agent will be permanently disabled.
You may not transfer, resell, or replicate the Ai agent or its configurations without prior written consent.

Payment Terms
A 100% upfront payment of the subscription fee is required prior to completing each Tier Survey and initiating the creation of your Ai agent. This payment ensures your commitment to the process and covers the preliminary setup and configuration costs.

This upfront payment is only refundable under the 60-day refund policy stated above.
For ongoing subscriptions, billing occurs on a monthly basis after project delivery.

Decommissioning and Termination
If you choose to terminate your subscription, your Ai agent will be decommissioned from our systems. Upon termination, you will lose access to the Ai agent and its functionality, and you will no longer be authorized to use any part of the Ai system.

Limitations of Liability
The Ai Work Flo is not responsible for any loss, damage, or liability resulting from improper configuration, incorrect business data provided during setup, or misuse of the Ai agent.

Performance and outcomes of the Ai agent depend on the accuracy of the information provided and the selected package features.

Support and Maintenance
Tier-specific customer support is included with your subscription. Additional support requests will incur extra fees at $110 USD per hour.

System updates and maintenance are performed periodically to ensure optimal performance and will always be billed at $110 USD per hour.

Training is available at $110 USD per hour.

Confidentiality and Data Privacy
Any business information shared during the setup process will be treated as confidential and used solely for configuring your Ai agent.

Dispute Resolution
The Ai Work Flo aims to resolve any disputes arising from these terms in a respectful and constructive manner.

If an agreement cannot be reached through initial discussions, we encourage amicable negotiation.
Should negotiations fail to provide a resolution, the matter may be escalated to arbitration.
